1. About ConfluxMind

ConfluxMind is an AI-powered companion that helps people practise emotional regulation skills. It is built on evidence-based psychological frameworks including Dialectical Behaviour Therapy (DBT) and Acceptance and Commitment Therapy (ACT).

ConfluxMind is operated by ALPHAWAVE TECHNOLOGIES LIMITED, registered in the United Kingdom.

By using ConfluxMind, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What ConfluxMind Is

ConfluxMind is a wellness tool. It is designed to help you practise emotional regulation skills through conversation with an AI companion. It may guide you through grounding exercises, breathing techniques, cognitive defusion, values clarification, and other skill-building activities drawn from DBT and ACT.

3. What ConfluxMind Is NOT

This section is important. Please read it carefully.

  • NOT therapy. It does not provide psychotherapy, counselling, or any form of clinical treatment.
  • NOT a medical device. It has not been registered or certified as a medical device in any jurisdiction.
  • NOT diagnosis. It cannot and does not diagnose any medical or mental health condition.
  • NOT prescribing. It does not recommend, suggest, or reference any medication.
  • NOT a replacement for professional help. If you are experiencing a mental health crisis, please contact a qualified professional, your local emergency services, or a crisis helpline.
  • NOT a crisis service. While we include safety features that detect crisis language and provide helpline information, ConfluxMind is not equipped to handle emergencies. If you are in immediate danger, call 999 (UK) or your local emergency number.

ConfluxMind is an AI system. You are interacting with artificial intelligence, not a human being. The AI may make errors, misunderstand context, or provide responses that are not appropriate for your specific situation. Use your own judgement.

4. Eligibility

You must be at least 13 years old to use ConfluxMind, in line with the UK Data Protection Act 2018 and the Age Appropriate Design Code. By using the service, you confirm that you are at least 13 years old.

If you are between 13 and 18, we recommend that you inform a parent, guardian, or trusted adult that you are using this service.

5. Your Use of the Service

5.1 Acceptable Use

You agree to use ConfluxMind for its intended purpose: practising emotional regulation skills. You agree not to:

  • Attempt to make the AI provide medical diagnoses, medication recommendations, or clinical treatment
  • Use the service to harm yourself or others
  • Attempt to bypass or circumvent safety features
  • Use the service for any illegal purpose
  • Attempt to extract, reverse-engineer, or replicate the AI system, prompts, or safety architecture
  • Use the service in any automated or programmatic way (bots, scrapers, etc.)

5.2 Your Content

You retain ownership of any content you share with ConfluxMind (messages, responses to exercises, etc.). By using the service, you grant us a limited licence to process this content solely for the purpose of providing the service. We do not use your content to train AI models unless you explicitly opt in to a research programme.

6. AI and Safety

ConfluxMind includes a multi-layer safety system designed to:

  • Detect crisis language and provide appropriate helpline information
  • Prevent the AI from generating harmful, diagnostic, or clinically inappropriate responses
  • Maintain clinical boundaries at all times

Despite these safeguards, no AI system is perfect. ConfluxMind may occasionally produce responses that are inaccurate, unhelpful, or inappropriate. If this happens, please let us know at imre@confluxmind.com so we can improve the system.

If the AI detects that you may be in crisis, it will provide information about relevant helplines and crisis services. This is an automated safety feature, not a clinical assessment.

7. No Medical or Therapeutic Relationship

Using ConfluxMind does not create a patient-therapist relationship, a doctor-patient relationship, or any other clinical or professional relationship between you and ConfluxMind, its founders, employees, advisors, or affiliates. Nothing in ConfluxMind’s responses should be interpreted as medical advice, clinical guidance, or a professional opinion. Always consult a qualified healthcare professional for medical or mental health concerns.

8. Privacy

Your privacy is important to us. Please read our Privacy Policy for details on what data we collect, how we use it, and your rights under UK GDPR.

9. Intellectual Property

All content, design, branding, software, AI prompts, safety architecture, and other materials that make up ConfluxMind are owned by ALPHAWAVE TECHNOLOGIES LIMITED and are protected by intellectual property laws.

The DBT and ACT frameworks themselves are not proprietary — they are evidence-based psychological approaches. ConfluxMind’s specific implementation, prompt architecture, and safety systems are proprietary.

10. Availability and Changes

ConfluxMind is provided on an ‘as is’ and ‘as available’ basis. We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the service at any time without notice.

We may update these Terms from time to time. Material changes will be communicated through the service or via email. Continued use after changes constitutes acceptance of the updated Terms.

11. Limitation of Liability

To the maximum extent permitted by law:

  • ConfluxMind is provided without warranties of any kind, either express or implied, including but not limited to warranties of fitness for a particular purpose or non-infringement.
  • ConfluxMind, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you have paid us in the 12 months preceding the claim, or £100, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

12. Indemnification

You agree to indemnify and hold harmless ConfluxMind, its founders, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the service in violation of these Terms or applicable law.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of ConfluxMind shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in Scotland, you may also bring proceedings in Scotland. If you are a consumer resident in Northern Ireland, you may also bring proceedings in Northern Ireland.

Before initiating formal proceedings, we encourage you to contact us at imre@confluxmind.com to attempt to resolve any dispute informally.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
